For most Lawrence Kamin business clients, lawsuits and disputes are a double-edged problem. Whether a contractual dispute, an action to protect trade secrets, or a suit concerning corporate control or management, any legal controversy may influence a company’s direction as well as its ability to meet its objectives. And virtually every lawsuit is a distraction from day-to-day business. Our challenge is to design and implement a strategy with our client that effectively blunts these risks, and accomplishes the client’s legal goals in the context of its business plan.
No single answer or strategy is appropriate for every case. Some matters may warrant an acknowledgement of liability and a quick resolution. Others might be resolved best through negotiation or alternative dispute resolution, such as mediation or arbitration. Still others demand uncompromising and unrelenting prosecution, and nothing short of trial and verdict will suffice. In all matters, however, we work with our clients to structure and execute an efficient, cost-effective litigation plan.
