LKSU Hosts Resolution Systems Institute's January Executive Committee Meeting
LKSU was pleased to host the January Executive Committee meeting of Resolution Systems Institute (RSI) www.Aboutrsi.org/, a Chicago non-profit organization whose mission is to strengthen justice by enhancing court ADR systems. RSI helps court ADR programs function in an effective manner while meeting the procedural justice needs of participants. RSI does this at the national level by providing informative resources on www.CourtADR.org, an online court ADR resource center. RSI also works directly with state and federal courts in Illinois to develop, monitor and evaluate court ADR programs. LKSU Partner Kent Lawrence is a long-time supporter of RSI and serves on RSI's advisory board.

John F. Mahoney Appointed to the Chicago Bar Association's Legislative Committee
In September 2011, partner John F. Mahoney was appointed to the Chicago Bar Association's Legislative Committee. The Legislative Committee reviews legislative proposals developed by the Chicago Bar Association's substantive law committees and makes recommendations to the Chicago Bar Association's Board of Governors for action.
As Mayor of the Village of Palos Park, John Mahoney participates in a number of cooperative governmental associations, including the Southwest Conference of Mayors, where he serves on the Transportation Committee, the Metropolitan Mayors Caucus and the Chicago Metropolitan Agency for Planning (CMAP), where he serves on the Council of Mayors Executive Committee.

Recent Changes to Illinois' Estate Tax Laws
On December 16, 2011 Governor Quinn signed legislation that will increase the Illinois' estate and generation-skipping transfer tax exemptions. Specifically, on January 1, 2012 these exemptions will increase from $2 million to $3.5 million, and then to $4 million on January 1, 2013.
What this means is that one can leave more money to one's family and friends ($1.5 million more next year and $2 million more in 2013) without incurring any Illinois estate or GST tax. If you have updated your estate plan (i.e. wills and trusts) in the past few years, you do not need to do so again, unless your circumstances have changed substantially (i.e., change to your marital status, birth or adoption of a child, receipt of an inheritance, etc.). Some significant differences still remain between Illinois and federal estate and GST taxes, so planning is necessary to minimize those taxes.

Paul Uhlenhop, John Monical and Mitchell Goldberg authored Outside Business Activity, an article published in Practical Compliance & Risk Management for the Securities Industry (a Wolters Kluwer publication, November/December 2011). The article provides a detailed discussion of: (1) the FINRA Rules and proposed rules relating to outside business activities and private securities transactions; (2) the arbitrability and theories of civil liability in selling away cases; and (3) suggested compliance procedures and best practices for minimizing outside business activity violations and exposure.

Mitchell Goldberg and LKSU Host Decalogue Law Student Event
On November 10, 2011, in collaboration with the Decalogue Society of Lawyers' Law Student Committee, Mitchell Goldberg and LKSU hosted a Decalogue Law Student Event entitled "Illinois State Court Clerkships: A Panel Discussion with the Judges." Speakers included Justice Robert Gordon, Judge Moshe Jacobius and Judge Allen Goldberg. The event offered the opportunity to learn about the Illinois state court system from the judges who preside within it and the clerks who make the system work. Participants learned more about the role of law clerks in the different divisions and insight into applying for these exciting jobs.

Mitchell Goldberg and LKSU Host Networking Workshop
On September 21, 2011, in collaboration with DePaul Law Career Services, Mitchell Goldberg (Partner at LKSU and DePaul ASK (Alumni Sharing Knowledge) Mentor) hosted a networking workshop entitled "Networking Skills Building: Becoming the Person Others Want to Know" at LKSU's offices. The workshop brought together recent DePaul Law graduates and professionals to allow for an informal networking training session.
The workshop included a panel discussion on joint networking skills entitled: "Keys to Being a Resource, Promoting Others and Building a Networking Plan." The panel included Cheryl Kettler (Adjunct Faculty, DePaul University College of Law Legal Writing and Transactional Legal Drafting), Bonnie Tunick (Assistant Director, DePaul University College of Law Career Services), and Mitchell Goldberg. LKSU Welcomes Summer Law Clerk Christina Mermigas
LKSU is pleased to welcome Christina Mermigas as a summer law clerk. Christina is a student at DePaul University College of Law, where she has already distinguished herself as an intern for the International Human Rights Law Institute, and as a fellow for the Schiller DuCanto & Fleck Family Law Center, in addition to serving as an officer of that school's chapters of the Women's Bar Association and as a representative for the International Law Society. During her first year of law school, Christina also merited a posting as a law clerk to the misdemeanors and domestic violence divisions of the Cook County State Attorneys Office in Maywood, Illinois, where she earned the admiration and respect of the attorneys and judges she worked with. Christina graduated magna cum laude from Seton Hall University, where she received the Seton Hall University Scholarship for Academic Excellence and the Seton Hall University Servant Leadership Scholarship, in addition to being inducted into the Sigma Iota Rho, International Relations Honor Society. On June 17, 2011, LKSU Partner Mitchell Goldberg, who serves as Illinois State Liaison to the National Inns of Court, joined other Inn leaders from around the 7th Circuit at a leadership summit. The summit was designed to offer Inn leaders the opportunity to learn from their peers, share ideas for development of programs and Inn procedures, and collaborate on tackling issues facing Inns today. Mitch served as one of the "facilitators" during the day's programs. The event was held at the Jenner & Block Conference Center in Chicago.

LKSU Partner Thomas Bennington Elected to United Way of Metropolitan Chicago Board
Lawrence Kamin Partner, Thomas Bennington, was elected to an additional 3 year term on the United Way of Metropolitan Chicago Board of Directors beginning on June 2, 2011. Tom has served on the Board since UWMC's inception in 2004 and currently is a member of its Executive Committee. In addition to re-election, UWMC has recognized Tom in the past, awarding him the Volunteer Leadership Award, Volunteer Excellence Award and its highest volunteer award, the Outstanding Volunteer Award.
UWMC is the largest non-governmental funder of health and human services in Illinois providing expertise and funding in 238 communities located in Chicago, Cook and DuPage Counties and parts of Will, Kane and Lake Counties utilizing nearly 8,600 volunteers. Bennington elected to Boy Scout Board
Tom Bennington was re-elected to the Executive Board of the Boy Scouts of America Des Plaines Valley Council on February 17, 2011 for an additional one year term. The Des Plaines Valley Council serves the youth of 42 communities in Cook and DuPage counties. Bennington serves on the Council's nominating committee and as Chairman of Tall Grass District, the Council's geographic area in DuPage County. As Chairman, Bennington is responsible for coordinating various efforts of Scouting's 1,000+ adult volunteers in the District.
The Boy Scouts of America was incorporated in 1910 to provide a program for community organizations that offers effective character, citizenship, and personal fitness training for youth. Specifically, the BSA endeavors to develop American citizens who are physically, mentally, and emotionally fit; have a high degree of self-reliance as evidenced in such qualities as initiative, courage, and resourcefulness; have personal values based on religious concepts; have the desire and skills to help others; understand the principles of the American social, economic, and governmental systems; are knowledgeable about and take pride in their American heritage and understand our nation's role in the world; have a keen respect for the basic rights of all people; and are prepared to participate in and give leadership to American society.

Bennington receives Boy Scout National Centennial Quality District Award
Tom Bennington, a partner with the law firm of Lawrence, Kamin, Saunders & Uhlenhop, LLC, was awarded with the 2010 Boy Scouts of America National Centennial Quality District Award. Bennington chairs the Des Plaines Valley Council's Tall Grass District, the Council's geographic area in DuPage County. As Chairman, Bennington is responsible for coordinating various efforts of Scouting's 1,000+ adult volunteers in the District.
The Centennial Quality Awards program is designed to recognize units, districts, councils, areas, and regions in achieving excellence in providing a quality program to a growing youth population in America at all levels of the Boy Scouts of America.
Bennington's involvement with Scouting has been extensive. He has served as Assistant Webelos Leader, Webelos Leader, Committee Chair, Pack Trainer, Assistant Cubmaster, and Cubmaster for Pack 48; Assistant Scoutmaster, Merit Badge Counselor, Troop Committee Member, and Chairman for Troop 99; Venturing Advisor for Crew 99; District Committee Member and Chairman for Tall Grass District; a scout trainer and course director for both district and council adult leader training; and, a member of the Des Plaines Valley Council Executive Board. He has received the Cubmaster Award, Cub Scouter Award, Webelos Den Leader Award, Boy Scout Leader's Training Award, District Committee Key Award, William D. Boyce New Unit Organizer Award, District Award of Merit, and the 2008 Tall Grass District Cubmaster of the Year Award.
His proudest Scouting accomplishments are his 3 boys – an Eagle, a Life, and a Star. His favorite times are spending time with them outside, without phones, internet or TV.
Bennington is a graduate of Wood Badge course C-04-04 and has served on the staff for Course C-20-06.

Mitchell Goldberg Offers Toast At Billy Goat Tavern Event Announcing Official Establishment of Carlos Hernandez Gomez Scholarship at DePaul University
On January 17, 2011, LKSU partner Mitch Goldberg joined family, friends, colleagues and admirers of the late Chicago Reporter Carlos Hernandez Gomez at the Billy Goat Tavern, located at 430 N. Michigan Ave., where the Carlos Hernandez Award in Journalism at DePaul University's College of Communication was officially announced. Mitch, a co-founder of the scholarship and a close friend of Carlos at DePaul, was asked to deliver the evening's toast to Carlos on the first anniversary of his death. The scholarship was officially announced by John Holden of DePaul University and the scholarship's honorary chair, Andy Shaw – both friends and colleagues of Carlos Hernandez Gomez. The event also marked MLK Day, and was capped off with songs from local musicians and long-time friends of Carlos, Phil Angotti, Eric Howell and Dann Morr.

Mitchell Goldberg and LKSU Host Networking Workshop
On November 17, 2010, Mitchell Goldberg (Partner at LKSU and DePaul ASK (Alumni Sharing Knowledge) Mentor) and Lisa Zulanas (Adjunct Faculty, Northwestern University College of Law School of Negotiation & Mediation) hosted a fourth networking workshop entitled “Networking Skills Building: Becoming the Person Others Want to Know” at LKSU’s offices. As with prior workshops, the event was designed to bring together students, recent graduates and professionals to allow for an informal “networking” training session. The workshop also provided a panel discussion on joint networking skills entitled: “Keys to Being a Resource, Promoting Others and Building a Networking Plan.” The panel included special guest speakers Dan Cotter, an attorney at Lindemann LLC, where he is Chair of the Corporate, Transactional and Regulatory/Compliance practice group., and Tula Rainwater, a marketing and training consultant focusing on small and medium sized businesses, and Mitchell Goldberg. In addition to the panel discussion, participants had an opportunity to receive on-the-spot coaching in joint marketing skills, and an opportunity to engage in open networking with other participants.

John Monical Raises $3,500 for Muscular Dystrophy
The Muscular Dystrophy Association ("MDA") raised over $47,000 during its lockup fundraising event in August 2010. During the event, volunteers agreed to be locked up, only to be released when they raised donations sufficient to meet their bail. John Monical (shown during his arrest by Ann Berwald of Lawrence Kamin) raised $3,509, placing him among the top three "bailraisers" of the event.
Lawrence Kamin would like to thank all of the participants who generously donated to the event. Proceeds will go to help kids with Muscular Dystrophy. John Monical Helps Form the NIU College of Law Mentoring Program
John Monical of Lawrence Kamin is helping to spearhead a mentoring program for the NIU College of Law. Monical proposed the mentoring program at the NIU Board of Visitors meeting in April. Board members David Keay and the Honorable Bill Haddad, along with alumni council members Kate McCabe and Doressia Hutton volunteered to join with Monical on a committee to explore and develop the mentoring program. A pilot of the mentoring program is scheduled to commence in the fall 2010. The pilot will pair first year law students with alumni and practicing attorneys from the bar community, who will act as mentors to the students, assisting in their introduction to the practice and the legal community. The program has received strong support from Dean Jennifer Rosato and the College of Law and strong interest from the alumni. John Monical and Lawrence Kamin would like to provide special recognition to Greg Anderson, Director of Career Opportunities and Development at the College of Law. Greg has worked tirelessly to collect information about other mentoring programs and to develop a feasible structure for the NIU pilot program. DRI Children’s Products SLG to Form a State Liaison Network
The Children’s Products Specialized Litigation Group (“SLG”) has always been one of the strongest SLGs in the Defense Research Institute’s Product Liability Committee, but for the 2011 year, it plans to get even better. John Monical, Chair of the SLG, has initiated a proposal to form a State Liaison network. The State Liaison network will be a state-by-state resource for SLG members charged with updating members of changes in state law affecting the Children’s Products Industry across the country. The SLG’s Marketing Chair, Jane North of Deasey, Mahoney, Valentini & North and the SLG’s Publications and Listserv Chair, Lynne Jones Blain of Harman Claytor Corrigan Wellman have agreed to spearhead this program and deserve the credit for its anticipated success on behalf of the SLG.

Mitchell Goldberg Co-Chairs Journalism Scholarship in Memory of Chicago Reporter Carlos Hernandez Gomez at DePaul University
Lawrence Kamin is proud to recognize Mitchell Goldberg's efforts, along with his longtime friend and colleague, Paul Fine, to create the Carlos Hernandez Award In Journalism at DePaul University's College of Communication. Mitchell and Paul were close friends of Carlos as undergraduates at DePaul University. Carlos went on to become a news reporter for WBEZ (Chicago Public Radio) and for CLTV News, where he covered local and national political issues. As a political reporter, Carlos was known for his trademark fedora hat, his sharp wit, and his unrelenting search for the truth. Carlos positively impacted many people during his life, which was cut short earlier this year in a battle with colon cancer. With the support of Carlos's family and widow, WGN News reporter Randi Belisomo Hernandez, Mitchell and Paul have devoted their time, efforts and money to help create a lasting tribute in their friend's memory. CBA Securities Law Committee Hosts its Spring Seminar

Mitchell Goldberg and LKSU host networking workshop for DePaul University's ASK (Alumni Share Knowledge) Program
On January 20, 2010, Mitchell Goldberg joined with other DePaul ASK mentors in putting on a networking workshop entitled "Not Working? Try Networking", at Lawrence Kamin's offices. The event was well attended by ASK mentees, including current students in DePaul's undergraduate and graduate programs, as well as young professionals and recent graduates. Apart from Mitchell, the hosting ASK mentors included: Juan Mir, Treasury Management Sales Manager for PNC Financial Services Group; Kevin J. | Paul Uhlenhop and Michael Wise pen updated chapter for Broker-Dealer Regulation, a Practicing Law Institute publication
Paul Uhlenhop and Michael Wise are the authors of updated Chapter 17A entitled “Clearing Arrangements for Introducing Brokers” in the Practicing Law Institute two volume work entitled Broker-Dealer Regulation, part of its Corporate and Securities Law Library. Broker-Dealer Regulation covers the whole field of broker-dealer issue. Chapter 17A discusses introducing broker clearing and operational mechanics from both the introducing broker’s standpoint and the clearing firm’s standpoint. It updates many of the areas addressed in the earlier version, and provides additional insights not discussed in the previous release. Chapter 17A focuses on the clearing relationship, particularly from the introducing broker’s standpoint and provides a detailed discussion on provisions for clearing agreements between introducing brokers and clearing firms. The chapter offers suggestions to both the introducing broker and the clearing firm regarding their respective agreements, rights and duties. Kent Lawrence's "Kickapoo Dwelling" on the 2008 National Tour of Solar Buildings.
On October 4, 2008 the second home of partner Kent Lawrence and his wife, located in Oregon, Illinois, 100 miles west of Chicago, was once again on the "National Tour of Solar Buildings" held around the nation. The home, called the Kickapoo Dwelling, was (and is in "reruns") one of the 26 homes world-wide featured on the 2008 first season series USA cable channel "Planet Green" (HgtvCA in Canada) "The World's Greenest Homes." Among other "green" features the home has three renewable energy systems: a passive solar wall for heating; a wind turbine; and photovoltaic panel array generating electricity. The Kickapoo Mud Creek Nature Conservancy - with which Kickapoo Dwelling is associated - is currently constructing the Kickapoo "Center". Back-to-School Fundraiser Program
Lawrence Kamin kicked off the upcoming school season by participating in the Communities That Care 2008 Back-to-School Program. The program provides new backpacks and school supplies for underprivileged children in the Chicagoland area.
Numerous backpacks were donated by Attorneys and staff, while Lawrence Kamin, along with vendor Warehouse Direct Office Supply Company, provided supplies. With over 90% participation office-wide, the event was a huge success and will provide backpacks and supplies to many children in need.

Partner and Mayor, John Mahoney Speaks to Save Swallow Cliff Toboggan Slides
On April 8, 2008, before a camera crew from ABC News and a reporter from WBBM Radio, Mayor of Palos Park John Mahoney and 30 Palos area residents boarded a school bus in Palos Park to appear before the Cook County Board (actually the Forest Preserve District, but the County Board Members serve as the members of Forest Preserve District). A copy of Mayor Mahoney's prepared comments is available here. Although the Board ultimately voted to approve the contract for demolition of the slides, and the slides have since been demolished by the County, Mayor Mahoney and area residents continue to pursue the rebuilding of the toboggan slides and are committed to restoring Swallow Cliff to its status as major area recreational attraction.

Association for Conflict Resolution Program
On January 16, 2008 Kent Lawrence, who also serves as Board Member and Treasurer of the Association for Conflict Resolution (ACR) / Chicago Chapter, led a program panel entitled “What Happens Before the Mediation: Pre-Mediation Techniques That Work”. The event, held in Lawrence Kamin’s extended conference center, was attended by 30 guests. With over 25-years experience in the Alternative Dispute Regulation field, Kent is well-versed in this area and considered a highly skilled arbitrator and mediator. For these reasons, Kent is proud to serve as an active member of the ACR, which is the only national organization dealing with, and having members involved with, all aspects of alternative dispute resolution. John Mahoney and Palos Park Step-up to Save Environment
On Saturday, September 15, 2007, our partner John Mahoney, who also serves as the Mayor of Palos Park, Illinois, played host to television and movie personality and noted conservationist Ed Begley, Jr., who served as the Grand Marshall of Palos Park’s Annual Parade and Chili Cook-Off. The Palos Orland Conservation Committee sponsored Mr. Begley’s appearance at the event, with Nicole Milovich-Walters moving mountains to arrange the visit. Mr. Begley also spoke at the event regarding various ways, large and small, in which folks can conserve energy. After Mr. Begley’s talk and a good bowl of Chili, Mr. Begley and Mr. Mahoney, along with Steve Buchtel of the Chicago Bike Federation and Dave Alm of the Palos Orland Conservation Committee, enjoyed a 20 mile bicycle ride through Palos Park and the Palos and Tinley Creek Forest Preserve. The Village of Palos Park is located in Southwest Cook County in a pastoral setting bordering 11,000 of the 60,000 acres of Forest Preserve in Cook County.

Charles Risch and John Monical Obtain Summary Judgment in Brain Injury Case
Charlie Risch and John Monical obtained summary judgment for the defendant in Hughey v. Kolcraft in Wayne County, Indiana, Superior Court.
The plaintiff alleged that her son had suffered serious brain injuries when he was ejected from a car during a high-speed rollover accident and that the proximate cause of those injuries was the failure of a defectively designed component of a car seat manufactured by Kolcraft. Charlie and John filed motions on behalf of Kolcraft seeking to bar the testimony of the plaintiff’s design expert, and for summary judgment. Charlie first argued in December 2006. On April 30, 2007 the court granted the motion to bar plaintiff’s design expert, finding that the expert did not have expertise in child restraint design and that his opinions of defect were speculative and not based on any reliable testing or scientific methodology. In July, at the Court’s request, Charlie reargued the summary judgment and on August 3, 2007, the Court entered an order and opinion granting the summary judgment motion, finding that:
1. Kolcraft was entitled to a rebutable presumption that its product was not defective and that it had not been negligently designed because Kolcraft had proven that the product complied with the relevant federal safety standards; and
2. Plaintiff had failed to point to any admissible evidence to rebut this presumption in light of the speculative and unsupported opinions of plaintiff’s design expert.
Charlie and John would like to thank and congratulate the entire litigation team: Don Snemis, a partner at Ice Miller, LLP in Indianapolis, who collaborated with Charlie and John on briefing and arguing the motions; Dr. Richard Stalnaker, of Ristal Engineering, Columbus, Ohio, who offered opinions supporting the motions that the Court cited and relied upon in its opinion; Dr. Dennis Guenther, of SEA, Inc., Columbus, Ohio, who performed the reconstruction on which Dr. Stalnaker’s opinions were based; and Eileen Lysaught, Kolcraft’s General Counsel, who supervised the litigation in-house and coordinated discovery responses.

Lawrence Kamin is pleased to announce that Mitchell Goldberg was invited to serve as a fellow at the Midwest Assembly of the Next Generation Project of the American Assembly of Columbia University. The Next Generation Project: U.S. Global Policy and the Future of International Institutions is a nonpartisan initiative intended to assess whether the current national security, multilateral and international institutions are enough to meet the challenges of the future, and will explore innovative organizational responses to an era of rapid globalization. Kent Lawrence Named to DePaul University College of Law Arbitration Planning Committee
DePaul University College of Law has formed a planning committee to explore the possibility of the school's Center for Dispute Resolution sponsoring a symposium on arbitration. Kent Lawrence of Lawrence Kamin has accepted Dean Weissenberger’s invitation to participate as a member. The committee, which held its first meeting on July 9, 2007, will explore the discontinuity between the reality of arbitration and how it functions, as compared with its depiction in court opinions, proposed legislation and the public media and academic journals.
